Information research The team had to submit a questionnaire containing only questions relevant to study in the efforts to get information on the company. This served as a pre-visit to the company which helped the owner and the administrator to prepare in advance. This also helped to avoid any inconveniences that would come in because the team would have interfered with the programs at the center. Some of the questions that we submitted were to find out some of the challenges incurred in running such a large facility, the response of the immediate community towards the establishment of the facility in the area, the revenues, their products and services and other operating processes. The group planned for the interview to be conducted by two of the members and to ask open ended questions to different people in the company in order to get their views. The best resource on this area was Dr. Lichtenberger who is the owner of the facility and the administrator, Frank Mahler. They answered the questions both directly and expressing their views about the hospital in general. Since we organized the interviews in a way that each group comprised of two members, one member of each group asked questions, while the other one did the recording of the answers through taking notes. We had two groups each interviewing the owner of the hospital and the hospital administrator independently, after which we compared the responses. The members were to be principally sensitive to the kind of job that goes on in the hospital and use their observatory instincts in partly collecting information. Similarities between Photosynthesis and Aerobic Respiration Photosynthesis and aerobic respiration are both part of a cyclic process of biochemical reactions. Photosynthesis requires the products of aerobic respiration (carbon dioxide and water), while aerobic respiration requires the products of photosynthesis (glucose and oxygen). Together, these reactions are involved in how cells make and store energy. The energy transfers in both processes and in how the gas exchange between oxygen and carbon dioxide occurs and the end products that result from each process are somewhat opposite processes, thus aerobic respiration and photosynthesis are in some ways complete opposites of each other. Photosynthetic organisms such as plants use solar energy to reduce carbon dioxide into carbohydrates. During respiration glucose is oxidised back to carbon dioxide, in the process, releasing energy that is captured in the bonds of ATP. Although these two energy producing processes differ in their uses and also their goals, they do have several similarities. Photosynthesis is a chemical process that takes place in the presence of sunlight, wherein plants manufacture their food and build stores of energy. This phenomenon occurs in chlorophyll containing plant cells. Chlorophyll is a pigment found in plant leaves that gives the plant its green colour. Chlorophyll absorbs the light energy and utilises it to produce carbohydrates from carbon dioxide and water. These carbohydrates produced are used by the plants as a source of immediate energy for growth, reproduction, and absorption of nutrients. The chemical reaction produces oxygen which is released into the atmosphere. Photosynthesis can be summed up by the following equation: 6CO2 + 6H20 + Sunlight à ¯Ã†â€™Ã‚  C6H1206 + 6O2, (fig1 below illustrates the process of photosynthesis) Occurring in the chloroplast light reaction converts solar energy to chemical energy of ATP and NADPH.The light reactions use the solar power of photons absorbed by Photosystem I and II. These are light gathering antennas containing the chlorophyll primarily responsible for absorbing the light. Electrons are also carried from Photosystem I and II via NADPH to the Calvin cycle. The Calvin cycle uses ATP NADPH to convert CO2 to sugar.CO2 enters the cycle leaves as sugar. The sugar product of the Calvin cycle is not glucose but a 3 carbon sugar called 3-Phosphoglycerate. This 3- Phosphoglycerate with the addition of another phosphate group from ATP forms glyceraldehyde-3-phosphate .In order for one of these G3P molecules to be synthesised the cycle must take place 3 times, fixing 3 molecules of CO2.There are 3 phases of the Calvin cycle, the carbon fixation phase, the carbon reduction phase and the regeneration phase. Cellular respiration is the process of oxidising food molecules or breaking down chemical bonds of glucose into carbon dioxide and water. The energy released in the process is trapped in the form of ATP and used by different energy consuming activities of the cell. It is a set of metabolic reactions that unlike photosynthesis which occurs in the chloroplast, cellular respiration occurs in the mitochondria. The complete breakdown of glucose into carbon dioxide and water involves two major steps: glycolysis and aerobic respiration. Glycolysis is the anaerobic catabolism of glucose that occurs in all the cells and produces two molecules of ATP. Aerobic respiration is the process in which the pyruvate molecules produced by glycolysis undergoes further breakdown in the presence of oxygen and generates thirty four molecules of ATP. This reaction can be described as follows: C6H1206 + 602 à ¯Ã†â€™Ã‚  6CO2 + 6H2O + Energy (38 ATP)(fig2 below illustrates cellular respiration) Cellular respiration beginning here with glycolysis catabolises glucose into 2 molecules of pyruvate. The net yield from glycolysis is 2 ATP 2 NADH per glucose. Electrons are carried from here to the electron transport chain via NADH. Pyruvate enters the mitochondrion where it gets modified to Acetyl COA. This then enters the Krebs cycle. The Krebs cycle completes the oxidation of the organic fuel to CO2.Electrons produced here are carried via NADH FADH2 to the electron transport chain oxidative phosphorylation. In the Krebs cycle a further 2 ATP is produced. Once there has been a sufficient energy shuttle of NADH from glycolysis, a maximum yield of 34 ATP is produced by oxidative phosphorylation. This then gives a maximum of 38 ATP produced. Photosynthesis is a reduction-oxidation reaction, just like respiration. In respiration energy is released from sugars when electrons associated with hydrogen are transported to oxygen (the electron acceptor), and water is formed as a by-product. The mitochondria use the energy released in this oxidation in order to synthesize ATP. In photosynthesis, the electron flow is reversed, the water is split (not formed), and the electrons are transferred from the water to CO2 and in the process the energy is used to reduce the CO2 into sugar. In respiration the energy yield is 686 kcal per mole of glucose oxidized to CO2, while photosynthesis requires 686 kcal of energy to boost the electrons from the water to their high-energy perches in the reduced sugar light provides this energy. Outlined above are the main differences between the two processes. However, photosynthesis and cellular respiration are two processes that both involve electron transport chains and they both affect concentrations of carbon dioxide and oxygen in the atmosphere. Both photosynthesis and cellular respiration provide energy to the organisms cells. It is interesting to note the structural similarities between Chlorophyll, that plays an important role in photosynthesis and Haemoglobin that is involved in cellular respiration. Both structures are practically identical except for the fact that haemoglobin has a central Iron atom and chlorophyll possesses a central Magnesium atom. Haemoglobin is a protein that carries oxygen in the blood. Where chlorophyll is known for its green pigment, haemoglobin is known for its deep red pigment. Both photosynthesis and respiration are also similar in that they both undergo chemiosmosis. Chloroplasts and mitochondria generate ATP by this same basic mechanism. In both kinds of organelles, electron transport chains pump protons (H+)across a membrane from a region of low H+ concentration to an area of high H+ concentration.The protons then diffuse back across the membrane through ATP syntheses, driving the synthesis of ATP. (fig 3 below illustrates this.) To conclude from this, photosynthesis and cellular respiration are the most vital biochemical pathways to life. They both include cycles, stages and many enzymes to function. Although their similarities can be easily recognised, it is their differences that make them stand apart as opposite processes. Photosynthesis requiring light in order to produce its end product, carbohydrate, and cellular respiration requiring carbohydrate in order to produce its end product energy.

Homage to Albrecht Durer Essay -- Biography

Albrecht Durer is known as one of the most gifted painters and engravers of the German Renaissance period. His works are known throughout the world and have inspired artists to not only study and learn his techniques but also to broaden his techniques, expanding his already famous style. Albrecht Durer was born on May 21, 1471 in the city of Nuremberg, Germany. His parents were Albrecht Durer and Barbara Holper. â€Å"His father was a successful goldsmith, originally named Ajtà ³si, who in 1455 had moved to Nuremberg from Ajtà ³s, Hungary†(Strieder). His Father married Barbara Holper who was actually the daughter of his goldsmith master. Durer was one of fourteen to eighteen brothers and sisters, many of which died young. At the age of thirteen Durer was educated at the Lateinschule in St Lorenz and also worked as an apprentice under his father and was fortunate enough to be familiar and have relationships with some of the greatest metal smiths of his generation. When Durer turned fourteen he began approaching his father with his paintings, hoping that if his father realized his artistic ability and skill he would let him study painting. There was a compromise; Durer was able to study his art after he mastered the goldsmith trade. His father showed him as much as he could and all of painting that he knew, until Durer’s skills soon surpassed his fathers. In 1486 Durer became an apprentice painter and woodcut artist to Michael Wolgemut. â€Å"Wolgemut was a leader among the artists revitalizing the standards of German woodcut at the time, providing the many publishers in Nuremberg with book illustrations†(Hapgood). His woodcuts followed the developments in engraving to portray volume and shading to a much greater degree than before. A... ...ng Hare, drawn a year before The Great Turf. Durer enjoyed his studies of realistic nature and always pushed himself almost to the edge of realism but holding back by adding a touch of abstract to add contrast. Artists pay homage to other artists all the time, either out of respect for the artist or to give tribute to their often unique style. Many artists believe it add a depth to their artwork that they alone cannot add so by using someone elses work to inspire or to enhance their own piece. Also by using the same or similar techniques it can add a sense of history or story to an art piece. Many artists have paid homage to Albrecht Durer. Homage for his many styles and homage for his many technique, from his engravings, to his water colours. One homage given to Durer is by Karen Kitchel through her piece â€Å"American Grasslands† in reference to â€Å"The Great Turf†.

Dreamland by Sarah Dessen Essay

Dreamland written by Sarah Dessen is a book about a young woman named Caitlin. Caitlin was a normal girl in high school, living with her parents and her older sister Cass. Cass is the very opposite of Caitlin. Cass is outgoing, popular, a cheerleader, and was recently accepted into Yale. But on the morning of Caitlin’s sixteenth birthday, her and her parents wake up to find Cass’s letter telling that she ran away to New York to be with her boyfriend. Everybody’s about to change but Caitlin most of all. With everybody in a panic to find Cass, Caitlin just stays to herself knowing that Cass always knows what she is doing. After about 3 weeks everything calmed down. Caitlin tries to find something to keep her mind off of things. So her and her best friend Rina tried out for cheerleading and made the team. Her mom was more exited about it than she was. Her mom was at every practice and game cheering Caitlin on. Although Caitlin didn’t cheerleading at all, she was just happy her mom was happy. With her being a cheerleader now she hung out with the other cheerleaders and the football players. She was expected to be perfect and to date a football player. But that just wasn’t her. Then one night at a party she meets Rodgerson. She falls in love with him right away. With his mysterious side and dreamy green eyes he was perfect to her. She soon found out that he sells drugs and smokes cigarettes. But she loves being around him and being with him. She started smoking too and doing drugs with him. Everything was going perfect; her parents really liked him. One night Rodgerson was showing Caitlin around his house when he was supposed to be meeting with his father. When his father stormed through the room Caitlin hid behind the door and watched Rodgerson’s dad yell at him and he suddenly hit him right across the face. Rodgerson fell to his feet while his dad kept yelling and finally left, slamming the door behind him. Caitlin, stunned, slowly walked over to Rodgeron on the floor and just hugged him trying to be there for him. After that night they never talked what happened. Caitlin never brought it up, only because she was afraid of what she may find out. They just acted like nothing had happened. Even when she noticed new bruises on his body knowing where they had come from. One day she was let out from school late and Rodgerson had been waiting for over 45 minutes for her. She new he would be upset because he hated to wait. She was nervous as she got into his car so she immediately tried to explain what had happened when he told her to shut up and hit her right across the cheek. She couldn’t move, not just because of the excruciating pain but because she was so surprised. She just sat back in the seat and they drove in silence. Before she got down to get in her house he apologized not looking her in the eye and she just nodded slowly. When she got inside she told her parents that she had slipped outside on the black ice. They believed her. After what happened they never talked about it again. She just ignored it and thought he wouldn’t do it again. Then he hit her again, and then again. He would hit her almost every time he would get upset. She didn’t know what to do so she just covered the bruises with bagging clothes and if someone saw she would just make an excuse. Her grades were failing, she quit cheerleading, and was doing more drugs. She was always in a daze, in a dreamland. It was the first day April, the annual party at Caitlin’s house. While everyone was busy making food and setting up, Caitlin decided to stay in bed all day since she didn’t have to meet Roderson until later. Then Rina came, they hadn’t talked in months. She woke Caitlin up with a bathing suit and suntan lotion in hand. She told Caitlin they where going to the lake. She didn’t give her any option. Especially when everyone was telling her to go too. Caitlin was so nervous that she would have Rodgerson waiting on her. She tried to tell Rina, but she didn’t listen. So she tried to call Rodgerson but he wouldn’t answer. When she finally made it home, she saw his car. She ran to his car and got inside and immediately told him what happened. He slapped her and punched her so hard the door opened and she fell out of the car onto the grass. She couldn’t get up the pain was too much. He started to yell at her to get up, but she couldn’t. She could here the party behind her, she was praying someone would just come out to find them. The neighbor across the street saw it all and called the police and her mother. She could feel her mother come up behind her crying and screaming. She could here commotion and sirens getting closer and closer. All she could remember was Rodgerson being handcuffed and taken away. Finally awaken from her dreamland, Caitlin is taken to a rehabilitation center for care. They did not press charges on Rodgerson. Rodgerson had to do community service and goes to jail frequently. After several months of her rehabilitation, she went home to her family and friends. She had no more bruises or pain. She was back to herself, she was happy. But what made her most happy was seeing her sister Cass comes out behind everyone and gives her a hug. Overall, I did really like this book. It taught me lessons and I hope it teaches other girls the lessons too. One example is how to always tell someone if your hurting or something is happening in your relationships. I did get a little bored while reading some parts because it was on going and over detailed. That is the only thing I did not enjoy about it. But this book was a very good one, and I would recommend it all girls. To first see how some people could hurt you when you least expected and to always have someone to talk to and not hide from it.

The importance of memory What will happen if all human lost their memory? What if we can’t remember anything anymore? Can our society keep running? Can we live? The answer is simple. We can’t live without memory and the modern society will be destroyed. Here I’ll explain to you one by one. Memory plays a big role in our life. It is the processes by which information is encoded, stored, and retrieved. Everything we see, we do, we think, will goes to memory and transform to implicit or explicit memory. Which will be saved in our brain.We could recall it anytime, even I’m using my implicit memory to type this report. Simply, our daily life is formed by memory, without it, we’re nothing. Why? If we don’t have memory, we can’t learn. Learning requires memory, if we’re unable to learn anything, we can only follow our basic instincts to live such as eating or having sexual intercourse. We’ll be worse than beasts if we live like that. Furthermore, we won’t be able to recognize anything. Somebody doubt that can we still learn from classical conditioning?The answer is no, because we can’t save the conditioned stimulus in brain, we don’t even remember we’re triggered by stimulus. Therefore, we won’t elicit by any conditioned stimulus. So if Pavlov’s dog don’t have memory, the whole theory won’t even exist. Without memory, we’ll lost many of our abilities and skills. Such as, languages, recognition. Unless we record everything we saw immediately and save it in a notebook. If human started with no memory, the modern society won’t be formed. Memory is an important part of what keeps society together, what shapes our culture, and what shapes us as individuals.We will be unable to develop anything. There won’t be revolution, human history can’t go further without memory. Therefore, It’s disastrous if human don’t have m emory at all. If we totally without implicit memory, human simply won’t exist. Breathing is an implicit memory. No one taught you to breathe, you just do it when you are born. If we don’t have implicit memory, no human will exist unless ape don’t have to breath. But it’s impossible that all human lost both his explicit and implicit memory, so the above parts is only a imagination.Let’s move on and talk about those people who have memory disorders such as Amnesia and Alzheimer’s disease. Memory disorders hinders the storage, retention and recollection of memories. That means their memory system are malfunctioned. The consequences could be very serious. Assume that i have Alzheimer’s disease, If i forget to lock my car, i i may lost it. If i forget to turn off my gas stove, it may cause explosion and I’ll die. As you can see, If we have memory disorders, we’ll face many troubles in our life, some are even life-threatening. Throw the with or without away, I’m now move on to next point. Which is how memory affect our personality and behaviour. Everyone got their own special personality. Memory has a deep influence on our personality, especially the early memories like your childhood. The best way to learn how early memories affect personality is to look at an example that analyzes someone's early memories. Here is one early memories of a middle aged man:â€Å"My little sister ate all the sweets in the box then when my mother asked her who did it she said that i am the one who ate them.I felt really angry†. Its clear that this guy has developed the belief that women are evil and that was perfectly aligned with his unexplained fear of the opposite sex. According to individual psychology all of the person's personality traits, beliefs, behaviour, thoughts and memories can be perfectly aligned to reflect the psychological goals he wants to reach. In the previous example one of the man's goals was to avoid women not to get harmed by them because he believed that they were evil.When we aligned his current psychological problems, his personality traits with his early memories we were able to see the full picture. Furthermore, there are some movies which can gives you more examples and perspectives, i recommend Frailty (2001), comprehensively explained how a religious fanatic father's visions lead to a series of murders by his son. To conclude, the importance of memory can’t be measure , a person needs proper memory or he can’t live normally and healthily, a society needs people like this to run or we’ll back to stone age.

Chopin Kate essays Kate Chopins Symbolic Use of Nature Kate Chopin uses nature and symbolism throughout her three short stories. Her vivid use of nature and its elements allow the reader to get a realistic view of the characters and their setting. By using nature to represent the feelings of her characters, Chopin allows the reader to evoke emotions they might have felt during similar times or situations. A simple example of symbolism would be the use a dark forest in a story. The dark forest could possible represent evil or confusion (1380). Like the example Chopin uses a specific season like spring or naturally occurring thunderstorms to symbolize new life or uncontrollable passion. In the first story the reader encounters Babette and Maman-Nainaine. Quickly the reader learns that Babette is waiting for the figs to ripen before she is allowed to visit her cousins. Figs have little if nothing to do with Babette being able to leave, but instead they symbolize her coming of age. Figs tend to ripen in late spring to early summer. Spring and summer are times of life and growth. So Babette is like a ripening fig that has to grow and mature before its ready. Finally when the figs ripen Maman-Nainaine says, How early the figs have ripened this year!(4) Babettes response is I think they have ripened very late(4). Babette is trying to say to Maman that she is mature and that she has been for quite some time. On the other hand Maman is telling Babette that she has ripened into a young lady very quickly. Chopins use of symbolism in this story is easy for most readers to relate to because we have all been in a situation similar to Babettes at one time. Eventuall y we all ripen as Babette does in Chopins use of spring carries over to The Story of an Hour. The reader fins the fragile Mrs. Mallard coming to the realization that her husband is dead. Â   Abstract: I nt r odu c t i on : The prostate cancer (PCa) treatment is multimodal. Thus multidisciplinary team management (MDTM) decision-making process appears as a tool to answer all aspects of PCa. To evaluate the reproducibility of therapeutic decisions made at MDTM. M a t erials a n d M e thod s : We compared therapeutic decisions of PCa by presenting the same file of patient under a fake identity after 6 to 12 months from the first presentation. Forty-nine files of radical prostatectomy (RP) (28 pT2, 21 pT3) performed for clinical localized PCa were represented at MDTM which included urologist, oncologist, pathologist and radiologist. Analysis of therapeutic decisions comprised criteria as: TNM stage, Gleason score, margin status and comorbidities. The reproducibility was assessed statistically by Kappa coefficient. R es u l t s: Forty-nine file of radical prostatectomy (RP). The mean age was similar in both groups. The mean PSA was 8,32 ng/ ml (3,56-19,5) in pT2 group and 9.4ng/ml (3,8-22) in pT3 group. The margin status was positive in 25% and 47,6% respectively in pT2 and pT3 group. Decision made for pT2 group were the same in 100% case (k=1). In the group of pT3 (n=21), 33% of decision were different at second MDTM, especially for pT3b with only 29% reproducible decision (k= 0,1). Concerning pT3a, 86% of decision were reproducible (k= 0,74). Con cl u s i on : We showed a reliability and reproducibility of decision made at MDTM when guidelines are well defined. The therapeutic attitudes were less reproducible in locally advanced PCa but decision concerning those cases should be made in the setting of guidelines. The PCa counts for 11% of all men cancers and it’s responsible for 9% of the mortality by cancer in men in Europe. In France in 2010, the incidence of PCa was 71577 cases and the related mortality of PCa at the same year was 8791 deaths which represent a 2.5% less mortality per year during last years (2). The multidisciplinary team management becomes an obligation for all oncologic fields as mentioned by the French government law: cancer program 2003-2007, this program stipulate that each new patient should benefit from MDTM decision-making process, organize the setting of MDTM and also gives tools to develop trials of research for a new diagnosis and therapeutic arsenal (3). Some urologists express some doubt about the interest of MDTM because of it’s a new burden without assigned budget while others see in the MDTM an equalit y of chance of patients, and possibility to include patients in trials and protocols. Number of European study showed the interest of MDTM and its beneficial impact on survival (4, 5). The efficiency of decisions made at MDTM is obvious but the evidence about their reproducibility remains doubtful. Through patients underwent a radical prostatectomy (RP) for localized prostate cancer (PCa) and represented identically, we evaluated a reproducibility of decision made at MDTM.

Isotoner Case Brief Essay Facts of the Case: LaNisa Allen appealed the original judgment in favor of Totes/Isotoner Corporation on the issue of whether the Ohio Fair Employment Practices Act, as amended by the Pregnancy Discrimination Act, prohibits an employer from discriminating against a female employee because of or on the basis of lactation. Relevant law associated includes whether Allen established a prima facie case of â€Å"sex discrimination on the basis of pregnancy,† or whether she â€Å"was simply and plainly terminated as an employee at will for taking an unauthorized, extra break. † Allen’s original complaint was termination attributable to discrimination, based on pregnancy and related conditions, even though Isotoner claimed to have released her for failure to â€Å"follow directions.† Evidence admitted in Allen’s disposition of taking unauthorized breaks for a two week period, which constituted the failure to follow directions, confirmed the trial courts summary judgment. As the trial court granted judgment to Isotoner, the Twelfth District Court of Appeals followed suit, as Allen admitted to ignoring directions and failed to establish a prima facie case of sex discrimination on the basis of pregnancy and it’s after effects. Issues: Although the lower courts concentrated upon the apparent facts of the case, especially â€Å"Whether Allen’s unauthorized breaks to pump her breast in order to avoid lactation constituted as sex discrimination†; a more superior issue arises from this case. Assuming a proper prima facie case was established, â€Å"Is purported discrimination due to lactation included within the range of Ohio’s employment-discrimination statute, R.C. 4112.02, as sex discrimination under R.C. 4112.01(B)?† Decision s: Ruling of the initial appeal of judgment in favor of Totes/Isotoner Corporation for discrimination Allen was affirmed. Subsequently, the Supreme Court of Ohio did not touch the issue of whether purported discrimination due to lactation is included within the range of Ohio’s employment-discrimination statute, R.C. 4112.02, as sex discrimination under R.C. 4112.01(B). An opinion of whether they thought this discrimination did fall in that range was included in Judge O’Connor’s judgment. Reasoning: Rationale leading the judges in a majority opinion to affirm the initial judgment, stemmed from the failure of Allen to develop a record from which a jury could find in her favor. However, several  of the judges felt â€Å"lactation is a physical condition associated with pregnancy and childbirth, hence the FEPA, as amended by the Ohio PDA, prohibits discrimination against females because they are lactating.† It is proposed that the Supreme Court of Ohio should reach the merits to clarify the laws. Separate Opinions: Judgment was affirmed by Judges Lundberg Stratton, O’Donnell, and Cupp, JJ. , as they believed Allen was discharged for taking unauthorized breaks from her scheduled employment. Since Allen failed to present evidence of a discriminatory motive from Isotoner, or that reason for releasing her from employment was a ground for discrimination, Lundberg Stratton, O’Donnell, and Cupp, JJ. felt only the issues presented by the facts of Isotoner discharging Allen due to ‘unauthorized breaks’ should be decided on, while issues of the facts not directly placed on issue should only be responded to with advisory opinion. Judges Moyer, C.J. and O’Connor J. concurred in the foregoing judgment only. They assert lactation to fall within the scope of R.C. 4122.01(B) and that the statute prohibits employment discrimination against lactating women. Also, they oppose the claim of opinions regarding issues not directly placed on issue to be strictly advisory. â€Å"A cause will become moot only when it becomes impossible for a [***627] tribunal to grant meaningful relief, even if it were to rule in favor of the party seeking relief.† Moyer, C.J, and O’Connor J. claim these indirect issues to be live, not as remote possibilities or based on controversies that may never occur. Their assertion that â€Å"lactation is a physical condition associated with pregnancy and childbirth, hence the FEPA, as amended by the Ohio PDA, prohibits discrimination against females because they are lactating† is fully discussed. Dissent is issued by Judge Peifer, J. as he declares the question needed answered by Ohioans was not resolute. Peifer, J. claimed â€Å"the court should analyze the case by asking (1) whether the plaintiff stated a cognizable cause of action and (2) whether the facts support the alleged cause of action.† Emphasis was placed by Peifer, J. on the circumstance of unclear facts of the case such as why Allen’s unscheduled restroom breaks outside of scheduled break times were different from restroom trips made by coworkers outside of their scheduled break times. Also, Judge Peifer argued that cases should be accepted not because of how the result might affect the parties in the individual case, but because of how a holding might affect other persons similarly situated. Peifer held â€Å"employment discrimination due to lactation as unlawful pursuant to R.C. 4112.01(B), that clear public policy justifies an exception to the employment-at-will doctrine for women fired for reasons relating to lactation, and that LaNisa Allen deserves the opportunity-due to the state of the record-to prove her claim before a jury.† Analysis: The significance of this case relates to the importance of establishing suitable evidence for a prima facie case and also to ruling on issues brought forward by cases. Although the affirmed judgment in favor of Isotoner was applicable due to Allen’s failure to provide evidence of sex discrimination related to after effects of pregnancy, it is important for courts to reach a decision on such cases the holding will/has affected other persons similarly situated. Similar cases of discharge or unpaid circumstances have been previously governed, including Fejes v. Gilpin Ventures, Inc. 960 F. Supp 1487and Martinez v. N.B.C. Inc. 49 F.Supp.2d 305l, among others. Therefore sex discrimination due to the aftereffects of pregnancy affects many individuals in Ohio and throughout the United States, and therefore a ruling of whether purported discrimination due to lactation is included within the range of Ohio’s employment-discrimination statute, R.C. 4112.02, as sex discrimination under R.C. 4112.01(B) is vital in reducing sex discrimination in the workplace.

The Theme Of Power English Literature Essay In both Like Water for Chocolate (LWC) by Laura Esquivel and A Woman at Point Zero (WPZ) by Nawal El Saadawi, the author shapes the readers opinion on the theme of power. The theme power is presented in both of the books protagonists, Mami Elena and Firdaus. Both characters show significant feminine power throughout the book as vigorous and bold characters. Mami Elenas power is expressed through the actions she inflicts on her daughters and the capability to control each of their fates. Firdauss power is portrayed as a prostitute; using her status to manipulate mens desire to her own advantage. Woman at point zero narrates the story of Firdaus, an Eqyptian female of the 20th century, born and raised within the misery of lower class and chauvinist Muslim society. For Firdaus her mindset of power is simple: men have power and women do not. By birth, I was lower classà ¢Ã¢â€š ¬Ã‚ ¦ My Fatherà ¢Ã¢â€š ¬Ã‚ ¦. Knew very few things in lifeà ¢Ã¢â€š ¬Ã‚ ¦How to exchange his virgin daughter for a dowry when there was still timeà ¢Ã¢â€š ¬Ã‚ ¦How to bend over the headmans hand and pretend to kiss it, how to beat his wife and make her bite dust each nightà ¢Ã¢â€š ¬Ã‚ ¦.  [2]  El Saadawi describes Firdaus as a powerless character since birth, described as being lower class; and also a description of power represented by her father beating her mother. Because of her misfortunate cultural position, the character is persecuted by sexual harassment and constrained submission to male desire. As a result, female suffering and oppression is clearly identified by the reader throughout t he novel. Thus creating Firdaus, a prestigious prostitute, whose interaction with society is confined within the basis of male persecution, acquiring power over them. Such an appalling vision of the male gender is generated by concurring experiences of obnoxious masculine behavior. Accordingly, man is intentionally portrayed by the author as grotesque and gruesome. The phrase like water for chocolate comes from the Spanish como agua para chocolate.  [3]  This phrase is a common expression in Spanish speaking countries and was the inspiration for Laura Esquivels novel title (the name has a double-meaning). In some Latin American countries, such as Mexico, hot chocolate is made not with milk, but with water instead. Water is boiled and chunks of milk chocolate are dropped in to melt. The saying like water for chocolate, alludes to this fact and also to the common use of the expression as a metaphor for describing a state of passion or sexual arousal. In some parts of Latin America, the saying is also equivalent to being boiling mad in anger. Laura Esquivel creates Mama Elena the tyrannical, widowed matriarch of the De La Garza clan revolves around the subjugation of her daughters. Her fierce dominion over her three daughters inspires fear within all of them. All my life I have been searching for something that would fill me with pride, make me feel superior to everyone else, including kings, princes and rulers  [4]  This quote refers to how Firdaus discovers how vulnerable men are when a prostitute refuses to sleep with them. With the status of prostitution she is overwhelmed with power and feels in complete control. Men will explode in fear and offer larger sums of money simply because they feel as if they are losing their power over women; however they do not realize it is the prostitute gaining power. When she possesses money of her own, she has power over people who slander her, and can give herself a respectable name. Her mindset was only changed until she met a high class prostitute named Sharifa. Sharifa is portrayed as a wealthy high class prostitute who manipulates mens desire for sex to her own advantage. She acts as a teacher to Firdaus, teaching her how to use her physical appearances as a tool to attract men. This is whe re her power had originated from; the teaching from Sharifa. Soon after she notices Sharifa treats her as a tool, she runs away to be an independent prostitute and applies to skills she had obtained. As Sharifa states; She is free to do what she wants, and free not to do it.  [5]  Firdaus is able to do anything she wants, after being handed tips, and lessons by Sharifa she is able to take her prostitution status to a whole new level. The method Mama Elena uses to gain control over her daughters is by using violence and cruelty against them, whether psychological or physical . Obey your Mommy and Dadd.  [6]  This quote refers to how the daughters of Mama Elena have no choice but to obey Mama Elena, since their father had passed away before. Mama Elena already starts with power unlike Firdaus who has slowly to gain her power. If she couldnt marry, was she at least allowed to experience love? Or not even that?  [7]  Tita being the youngest daughter of hers is unable to marry or have children because of the ridiculous tradition. Whatever signs of love Mama Elena sensed inside of Tita she would try to disrupt and sabotage. This root of her evil is from her previous lover who had left her, if she senses one of her daughters loving someone else she will feel overpowered and powerless. After Tita meets Pedro Mama Elena sees his affection for Tita so she conjures a plot against Tita; thus introducing Rosaura to Pe dro. Soon after Pedro decides to marry Rosaura to get closer to Tita because he realizes her fate is sealed. Tita does not know of Pedros intentions and is mentally hurt by losing her only chance of gaining true love. She suffers harshly and spends a lot of her time weeping about this incident. If Mama Elena suspects the slightest idea that Tita has no fulfilled her duties, such as when she is suspected of messing up the sewing on the wedding present, or the poison put inside the wedding cake, she physically abuses her. She is beaten harshly and is always left with scars, bruises and injuries: this teaches the daughters that not to make the same mistake again and displays the extreme power Mama Elena holds over them. When Tita attempts to blames Mami Elena for Robertos death she picks up a wooden spoon and breaks Titas nose leaving her no medical care and to slowly endure the pain. Mama Elena was merciless, killing with a single blow. But then again, not always. For Tita she had mad e an exception; she had been killing her a little at a time since she was a child, and she still hadnt finished her off.  [8]   Nacha! Dont say that. It shows how Mami Elena had polluted the mind of Rosaura and how her power even though she was dead overruled Rosauras self conscience I now knew that all of us were prostitutes who sold themselves at varying prices, and that an expensive prostitute was better than a cheap one.  [10]  As a prostitute Firdaus uses her power to command higher and higher prices simply by denying men of their wants. She was able to control the prices for her service showing her power over men. Men would crave for her; Firdaus would use this to her advantage to make them suffer. As she becomes powerful and notorious as prostitute money starts piling in for her. She gets this mind sense that as you have more money you also get more powerful which she had learnt from Sharifa. When the pimp comes into the picture, Firdaus sees him as a threat blocking her uprising. The pimp threatens to defame her or kill her, proving that no matter how much she had, Firdaus was still vulnerable to men because she had something to lose. Both Esquivel and El Saadawi present the theme of power effectively through the characters, Mama Elena and Firdaus using a variety of techniques. Like water for chocolate and Woman at point zero, with its blatantly sexist narrator are two novels written by two different female writers in totally different cultural circumstances; Esquivel being raised in Mexico, and El Saadawi being raised in Egypt. The reader therefore inevitably obtains a different level of insight of the protagonists however the theme of power still conforms with similarities between them. Lord of the Flies was written in 1954, a time when commercialisation was not an issue and media hype only had subtle effects on society. The Beach was written in 1996, American globalisation had begun and the media played a massive part in society. The different times affect the novels in different ways. For example the technological jargon language used in The Beach is very different to the Standard English used in Lord of the Flies. Both novels are similar in some ways yet different in others, although either way they always have hints of pessimism. One of the ways the novels are different is genre. The Beach at first seems to be travel writing, so the reader expects to learn about the journey and culture of the back-packing land of Bangkok, yet the main character Richard travels to an isolated island, where there is a lot of different cultures and races and no one shares the same value systems, traditions, customs or beliefs so the genre seems shift slightly. With Lord of the Flies it’s apparent at first that Golding may have been influenced by the novels Robert Louis Stevenson’s Treasure Island, Daniel Defoe’s Robinson Crusoe and R. M. Ballantyne’s Coral Island. All are castaway’s novels. There is a reference to Coral Island the officer who finds the boys nods â€Å"Jolly good show. Like the Coral Island.† Golding wrote Lord of the Flies in 1954 after the war as a realist answer to The Coral Island. In the 20th century book we find the same two characters, Jack and Ralph both stranded on an uninhabited island without adult supervision. Their reaction to freedom and the unknown is absolutely different from Ballantyne's two young adventurers. Instead of bringing civilization, they create chaos, terror and death. The different reaction Golding’s characters illustrate a novel for the more mature reader as an adventure novel, which confounds the reader’s first expectations. Outline the reasons for the growth in global tourism over the last several decades

Tourism was never a major part of everyday life in a HIC. In 1955 there were approximately 36,000 visitors to Kenya in Africa and it generated i1. 6 million. However only a decade later (2005) there was about 1. 2 million visitors and that generated about i800 million. What are the reasons for this startling development? and what are the impacts on the environment and the local indigenous tribes or cities? Now a days there are more forms of tourism. These are: Ecotourism (a sustainable form of tourism that has respect for the environment and the local cultures), Adventure tourism (trekking, cycling, climbing etc) and cultural tourism (visits to historical sites, interesting cities and different cultures). In 1841, a mass excursion (expedition/trip) from Loughborough to Leicester was organised by Tomas Cooke. This was a huge success and after this Tomas Cooke went on to developed trips to more distance destinations. Also railways and sea link were opened up. Also 30 years after starting his excursions he started his first round the world trip (video 183 development of tourism sheet). From that point on holidays were the ‘must have for the people of Britain. ‘ Most of the rich people spent their holidays in Blackpool. In the early 1900's it became the resort for the ‘common people'. One of the main reasons for this was because there were ‘works week' which was a week of full pay for a holiday in Blackpool. Also the other reasons for the growth in global tourism are: people can retire early with pension and go on longer holidays. Also there are a lot more people with less children due to working so people can go on great adventure holidays without worrying about their children. There are also people with a greater affluence (people are generally wealthier than in the past, and there is more money to spend on luxury items such as holidays and leisure pursuits (new key geography for GCSE p. 231), there is also a lot more mobility and accessibility (the increase of car ownership and improvements in the roads, rail and air travel. These reduce travel time and make it a lot easier). Also there are more package holidays (cheaper holidays are possible with block bookings and deals where travel, accommodation and meals are all included in the price). And finally there are tonnes and tonnes of advertising for various luxury holidays. These include brochures and holiday programmes; these promote new and different places and activities. People are now more aware of holiday opportunities available to them. As you can see there are a lot of reasons for the recent growth of tourism and there will be plenty more in the near future. B. Parenting Techniques and Their Influences on Their Child’s Behavior and Habits Essay

Parenting techniques and beliefs are essential to the growth of any child. Parents instill habits, behaviors, and moral sense in to their children at an early age. Children benefit when parents engage themselves in to their child’s life. In saying that, parents also have to learn to adapt to what their child needs and teach them to assert themselves and become independent. Habits children pick up are usually either picked up from their parents or tolerated by their parents. It is the parent’s responsibility to assess what is right for their child and correct any bad habits they may learn along the way. Socioeconomic status is a huge factor in how a topic of parenting techniques can be studied. Any subject pertaining to parenting style and their influences can be linked to their social class. I will focus most of my discussion on the effects of overall parenting techniques and how socioeconomic factors and be linked to those techniques. Parenting techniques are a very important factor in the development of children. Children learn from an early age their moral senses, the behaviors and habits that are acceptable, and they develop an understanding on what role their actions can play in their life. Parenting along with socioeconomic status and culture are great determining factors in understanding how a child has learned from their parents and what to expect from that particular child. Parents evolve their parenting techniques as they learn how their child naturally behaves and as the child learns from what the parents have instilled. In the study conducted by Rubin, Nelson, Hastings, and Asendorpf (1999), the primary purpose was to investigate the relations between a child’s social inhibitions and the parent’s beliefs on how to best socialize their child. The study determined that both the mother and father tend to follow their child’s dispositional cues on how they should be socialized. The parents would adapt to how the child reacted in a social situation. For example, if the child exhibited shyness, they would alter how they went about socializing. In this study, I agree that parents do evolve with their children and with an agreed upon authoritative style of parenting, both the father and mother would act accordingly to what the study found. The study was a longitudinal study but only followed up once after the initial results; I believe the study would have been more effective had it been followed up until at the least early childhood. In terms of diversity, I feel this study could have been greatly improved upon. Differences may or may not occur between different cultures and races, but the researchers chose not to delve into any demographic exploration on the topic. The socioeconomic status of the parents could also have an effect on how they were able to socialize their child. If the family was from the working-class, they may not have time to socialize their children as effectively. Many factors could have made this study more effective in determining the socialization of the child and the parents’ influences. Children also take after their parents behaviors. Eating habits in children may be partly due to genetic dispositions but are greatly impacted by their environment and the behaviors they are being taught. Birch and Fisher’s (1998) main concern in their study was that childhood obesity was not just simply linked to genetic factors but also environmental factors. The risk of a child becoming obese with two obese parents is very high, opposed to having non-obese parents. This is due to the child following the bad eating habits of the parents. Genes and environment are highly correlated because they are both typically provided by parents. Obese parents would need to acknowledge that there might be an issue and act on it accordingly and instill good eating habits to their children. The researchers of this study also chose not to cover any demographic characteristics such as age or socioeconomic factors. A longitudinal study exhibiting ages when a child learns eating habits and gaining weight would improve the study. Socioeconomic status could also play a large role in what the child had available to eat. In many studies, it is said that many lower or working class families struggle with obesity due to the lack of funds to get healthier foods. Social status would also explain if the parents were not there to monitor what the child was eating. This would affect a lot of qualities in the study had it been chosen to be covered. Differences between race and social classes have been studied for many decades. In an article by Bodovski (2010), she stated that Lareau (2003) examined how socioeconomic status and race backgrounds influenced how parents raised their children and how the children benefited academically. The social class in which a family is raised shapes their values, behavior, and explains what they have available as resources. Middle-class and upper-middle-class families actively reinforce their involvement in their child’s learning and socialization. This social class has a wide array of opportunities to expose their children to including sports, art, dance, and many other extracurricular activities. Middle-class families also encourage their children to stand up for themselves through example and therefore the children learn cultural codes and behaviors that facilitate their achievement (Lareau, 2003). Lower-class and working-class families feel their primary responsibility to their children is taking care of their needs, such as housing, food, and clothing (Bodovski, 2010). These children usually socialize with other family members and their nearby community rather than participate in extracurricular activities. Typically, working-class families experience more hesitancies in asserting themselves and their children also learn these behaviors. Lareau (2003) did not find significant racial differences in parenting styles once social class differences between families were taken into consideration (Bodovski, 2010). This study was very well diversified. It focused predominately on socioeconomic status which is a large factor in how well a parent will have accessibility to resources for their children and it also explains how much time the children are around their parents. The study also features race and explained that there were no significant differences. Late-elementary school children were studied along with their parents, which I believe is a good age range to focus on for an effective study. These articles are just a few facets on how parents influence and teach their children. Overall, when looking at parenting techniques, it is always important to look at socioeconomic status and how the parents can adapt to their children’s needs.

ch Ado About Nothing Reflection In our grade ten English class we studied the book Much Ado About Nothing by William Shakespeare. I found this book interesting to read because it was different from any other Shakespeare book I had ever read. Before this play I had only learned about tragedies but some of the parts of this play that I understood I found funny. I found this book very interesting because it was easy to follow and many lessons to be learned. In this play there are many things to be learned from it even though it is from over 400 years ago.The language that this play is written in is sometimes hard to understand but with some reading over and careful thought, I understood. I think that because of the time that it was written in, the language is suitable for circumstances that happen in this play. The language in the 21st century has dramatically changed since the time of Shakespeare. I think the value of learning about this old play is to gain an understanding of the lang uage and time of these people. This play was written in a time where women and men did not always choose who they got married to.Women did not have the same rights as men in the shakespearian time, therefore most women had arranged marriages. Men were allowed to do whatever they please, but women were expected to be put together all of the time. A family's reputation could be ruined by the action of one daughter, sister ect. In today’s society people do things that wouldn’t even be imaginable back then. We are surrounded by a society telling us that chastity is not important, that is something you would never hear of in the Shakespearean time. While read the play, Much Ado About Nothing, the importance of a foil character became clear.While Hero and Claudio seem to be the main characters, Benedick and Beatrice mirror there love story. They seem to go through the same types of conflict and in the end everything is resolved. Also while reading this play, the theme of mar riage as a form of entrapment for women becomes visible. Hero, being the only daughter of Leonato, would be able to inherit her father’s possessions if she married. Also marrying into a higher status was very traditional. By Hero marrying Claudio his status would be raised. This play, Much Ado About Nothing, is classified as a comedy.I believe that this is a comedy because of the the numerous jokes, lacking of deaths, and the marriage. A classic Shakespearean comedy consists of a conflict being resolved and a marriage. In this case it was a double wedding, Hero and Claudio’s and Beatrice and Benedick’s. The theme of our year, healing broken relationships, fits well with this play. After Claudio accuses Hero of being of unfaithful, Hero and her family must forgive Claudio for his false accusation. Leonato does forgive him and gives Hero to be his wife. There is a happy marriage at the end of the play and all relationships were healed.

Coffee Shop Essay In this RFP the following definitions shall apply: â€Å"City† means the City of Surrey; â€Å"City Representative† has the meaning set out in section 1. 8; â€Å"City Website† means www. surrey. ca; â€Å"Closing Time† has the meaning set out in section 1. 3; â€Å"Contract† means a formal written contract between the City and a Preferred Proponent to undertake the Services, the preferred form of which is attached as Schedule B; â€Å"Evaluation Team† means the team appointed by the City; â€Å"Information Meeting† has the meaning set out in section 1. 4; â€Å"Preferred Proponent(s)† means the Proponent(s) selected by the Evaluation Team to enter into negotiations for a Contract; â€Å"Proponent† means an entity that submits a Proposal; â€Å"Proposal† means a proposal submitted in response to this RFP; â€Å"RFP† means this Request for Proposals; â€Å"Services† has the meaning set out in Schedule A; â€Å"Site† means the place or places where the Services are to be performed; and â€Å"Statement of Departures† means Schedule C-1 to the form of Proposal attached as Schedule C. Instructions To Proponents 2 Closing Time and Address for Proposal Delivery. There will be no extension to the Closing Time for the submission of proposals. 3 Information Meeting An information meeting may be hosted by the City Representative to discuss the City’s requirements under this RFP (the â€Å"Information Meeting†). While attendance is at the discretion of Proponents, Proponents who do not attend will be deemed to have attended the Information Meeting and to have received all of the information given at the Information Meeting. At the time of issuance of this RFP a meeting has not been scheduled. 4 Number of Copies Proponents should submit the original plus 5 hard copies (6 in total) of their Proposals. 5 Late Proposals Proposals received after the Closing Time will not be accepted or considered. Delays caused by any delivery, courier or mail service(s) will not be grounds for an extension of the Closing Time. 7 Amendments to Proposals Proposals may be revised by written amendment, delivered to the location set out above, at any time before the Closing Time but not after. An amendment must be signed by an authorized signatory of the Proponent in the same manner as provided by section 2. 3. Fax amendments are permitted, but such fax may show only the change to the proposal price(s) and in no event disclose the actual proposal price(s). A Proponent bears all risk that the City’s fax equipment functions properly so as to facilitate timely delivery of any fax amendment. 8 Inquiries All inquiries related to this RFP should be directed in writing to the person named below (the â€Å"City Representative†). Inquiries and responses will be recorded and may be distributed to all Proponents at the discretion of the City. Proponents finding discrepancies or omissions in the Contract or RFP, or having doubts as to the meaning or intent of any provision, should immediately notify the City Representative. If the City determines that an amendment is required to this RFP, the City Representative will issue an addendum in accordance with section 1. 9. No oral conversation will affect or modify the terms of this RFP or may be relied upon by any Proponent. 9 Addenda If the City determines that an amendment is required to this RFP, the City will post a written addendum on the City website at www. surrey. ca (the City Website) and upon posting will be deemed to form part of this RFP. Upon submitting a Proposal, Proponents will be deemed to have received notice of all addenda that are posted on the City Website. 10 Examination of Contract Documents and Site. Proponents will be deemed to have carefully examined the RFP, including all attached Schedules, the Contract and the Site (as applicable) prior to preparing and submitting a Proposal with respect to any and all facts which may influence a Proposal. 11 Opening of Proposals The City intends to open Proposals in private but reserves the right to open Proposals in public at its sole discretion. 12 Status Inquiries All inquiries related to the status of this RFP, including whether or not a Contract has been awarded, should be directed to the City Website and not to the City Representative. Proposal Submission FORM AND contents 2 Package Proposals should be in a sealed package, marked on the outside with the Proponents name, title of the Project and reference number. 3 Form of Proposal Proponents should complete the form of Proposal attached as Schedule C, including Schedules C-1 to C-4. Proponents are encouraged to respond to the items listed in Schedules C-1 to C-4 in the order listed. Proponents are encouraged to use the forms provided and attach additional pages as necessary. 4 Signature. The legal name of the person or firm submitting the Proposal should be inserted in Schedule C. The Proposal should be signed by a person authorized to sign on behalf of the Proponent. 1 If the Proponent is a corporation then the full name of the corporation should be included, together with the names of authorized signatories. The Proposal should be executed by all of the authorized signatories or by one or more of them provided that a copy of the corporate resolution authorizing those persons to execute the Proposal on behalf of the corporation is submitted. 2 If the Proponent is a partnership or joint venture then the name of the partnership or joint venture and the name of each partner or joint venturer should be included, and each partner or joint venturer should sign personally (or, if one or more person(s) have signing authority for the partnership or joint venture, the partnership or joint venture should provide evidence to the satisfaction of the City that the person(s) signing have signing authority for the partnership or joint venture). If a partner or joint venturer is a corporation then such corporation should sign as indicated in subsection (a) above. 3 If the Proponent is an individual, including a sole proprietorship, the name of the individual should be included. evaluation and Selection 2 Evaluation Team The evaluation of Proposals will be undertaken on behalf of the City by the Evaluation Team. The Evaluation Team may consult with others including City staff members, third party consultants and references, as the Evaluation Team may in its discretion decide is required. The Evaluation Team will give a written recommendation for the selection of a Preferred Proponent or Preferred Proponents to the City. 3 Evaluation Criteria The Evaluation Team will compare and evaluate all Proposals to determine the Proponents strength and ability to provide the Services in order to determine the Proposal which is most advantageous to the City, using the following criteria: 1 Experience, Reputation and Resources The Evaluation Team will consider the Proponents responses to items in C-2 of Schedule C including supplementary information. 3 Technical The Evaluation Team will consider the Proponents responses to items (i) to (vii) in C-3 of Schedule C. 5 Financial The Evaluation Team will consider the Proponents response to C-4 of Schedule C. (d)Statement of Departures The Evaluation Team will consider the Proponents response to C-1 of Schedule C. The Evaluation Team will not be limited to the criteria referred to above, and the Evaluation Team may consider other criteria that the team identifies as relevant during the evaluation process. The Evaluation Team may apply the evaluation criteria on a comparative basis, evaluating the Proposals by comparing one Proponents Proposal to another Proponents Proposal. All criteria considered will be applied evenly and fairly to all Proposals. 4 Discrepancies in Proponents Financial Proposal If there are any obvious discrepancies, errors or omissions in C-4 of a Proposal (Proponents Financial Proposal), then the City shall be entitled to make obvious corrections, but only if, and to the extent, the corrections are apparent from the Proposal as submitted, and in particular: (a)if there is a discrepancy between a unit price and the extended total, then the unit prices shall be deemed to be correct, and corresponding corrections will be made to the extended totals; (b)if a unit price has been given but the corresponding extended total has been omitted, then the extended total will be calculated from the unit price and the estimated quantity; (c)if an extended total has been given but the corresponding unit price has been omitted, then the unit price will be calculated from the extended total and the estimated quantity. 6 Litigation In addition to any other provision of this RFP, the City may, in its absolute discretion, reject a Proposal if the Proponent, or any officer or director of the Proponent submitting the Proposal, is or has been engaged directly or indirectly in a legal action against the City, its elected or appointed officers, representatives or employees in relation to any matter. In determining whether or not to reject a Proposal under this section, the City will consider whether the litigation is likely to affect the Proponent’s ability to work with the City, its consultants and representatives and whether the City’s experience with the Proponent indicates that there is a risk the City will incur increased staff and legal costs in the administration of the Contract if it is awarded to the Proponent. 8 Additional Information The Evaluation Team may, at its discretion, request clarifications or additional information from a Proponent with respect to any Proposal, and the Evaluation Team may make such requests only to selected Proponents. The Evaluation Team may consider such clarifications or additional information in evaluating a Proposal. 10 Interviews The Evaluation Team may, at its discretion, may invite some or all of the Proponents to appear before the Evaluation Team to provide clarifications of their Proposals. In such event, the Evaluation Team will be entitled to consider the answers received in evaluating Proposals. 12 Multiple Preferred Proponents and Changes to the Proponent Team The City reserves the right and discretion to divide up the Services, either by scope, geographic area, or other basis as the City may decide, and to select one or more Preferred Proponents to enter into discussions with the City for one or more Contracts to perform a portion or portions of the Services. If the City exercises its discretion to divide up the Services, the City will do so reasonably having regard for the RFP and the basis of Proposals. Likewise, the City reserves the right to ask for changes in the member/s comprising the Proponent Team as it deems beneficial to the overall composition of the Team and without any obligation to justify its preference. In addition to any other provision of this RFP, Proposals may be evaluated on the basis of advantages and disadvantages to the City that might result or be achieved from the City dividing up the Services and entering into one or more Contracts with one or more Proponents. NOT APPLICABLE 14 Negotiation of Contract and Award If the City selects a Preferred Proponent, then it may: (a)enter into a Contract with the Preferred Proponent; or (b)enter into discussions with the Preferred Proponent to clarify any outstanding issues and attempt to finalize the terms of the Contract, including financial terms. If discussions are successful, the City and the Preferred Proponent will finalize the Contract; or. (c)if at any time the City reasonably forms the opinion that a mutually acceptable agreement is not likely to be reached within a reasonable time, give the Preferred Proponent written notice to terminate discussions, in which event the City may then either open discussions with another Proponent or terminate this RFP and retain or obtain the Services in some other manner. General Conditions 2 No City Obligation. This RFP is not a tender and does not commit the City in any way to select a Preferred Proponent, or to proceed to negotiations for a Contract, or to award any Contract, and the City reserves the complete right to at any time reject all Proposals, and to terminate this RFP process. 4 Proponent’s Expenses Proponents are solely responsible for their own expenses in preparing, and submitting Proposals, and for any meetings, negotiations or discussions with the City or its representatives and consultants, relating to or arising from this RFP. The City and its representatives, agents, consultants and advisors will not be liable to any Proponent for any claims, whether for costs, expenses, losses or damages, or loss of anticipated profits, or for any other matter whatsoever, incurred by the Proponent in preparing and submitting a Proposal, or participating in negotiations for a Contract, or other activity related to or arising out of this RFP. 6 No Contract. By submitting a Proposal and participating in the process as outlined in this RFP, Proponents expressly agree that no contract of any kind is formed under, or arises from, this RFP, prior to the signing of a formal written Contract. 7 Conflict of Interest A Proponent shall disclose in its Proposal any actual or potential conflicts of interest and existing business relationships it may have with the City, its elected or appointed officials or employees. The City may rely on such disclosure. 8 Solicitation of Council Members and City Staff. Proponents and their agents will not contact any member of the City Council or City staff with respect to this RFP, other than the City Representative named in section 1. 8, at any time prior to the award of a contract or the termination of this RFP. 10 Confidentiality All submissions become the property of the City and will not be returned to the Proponent. All submissions will be held in confidence by the City unless otherwise required by law. Proponents should be aware the City is a â€Å"public body† defined by and subject to the Freedom of Information and Protection of Privacy Act of British Columbia. Schedule A SERVICES 1. GENERAL This RFP is inviting potential Proponents to submit Proposals to act as the tenant and sole vendor for a proposed coffee shop (the â€Å"Coffee Shop†) at the Surrey City Centre Library (the â€Å"Library†), currently being constructed at 10350 University Drive, Surrey, BC. The successful Proponent will be responsible for the managing and daily service of the Coffee Shop located on the ground floor of the Library. There will be an opportunity for the successful Proponent to provide catering for meetings and other similar functions, although it is not mandatory for the client to use the Coffee Shop for catering. 2. BACKGROUND As part of the Surrey City Centre plan review and update, the Surrey City Council has approved the construction of a new 5-level library. While the project is currently in the design phase, construction has commenced due to the fast track nature of the project. Currently excavation is complete on the basement and the ground floor slab and reinforcement is being set. It will be poured by Friday June 18, 2010. The Library is conveniently located near bus loops, transit and SkyTrain. The Library will eventually become part of a plaza where community celebrations will take place. Once completed it will be Surrey’s largest library at 75,000 square feet. The City’s new Library will be a unique state of the art environmentally friendly landmark that provides access to the broadest range of information, learning opportunities, and diverse cultural experiences. The new Library will be: The centrepiece for Surrey’s City Centre; adorned in architectural excellence for the 21st century, the library will contribute to the vitality of the city and put Surrey in a class with other great cities. A foundation for the City’s future success by boosting economic and cultural activity and attracting visitors from all parts of the country. A source of pride and a great public space, where the community gathers to celebrate, reflect, connect and share information, knowledge and culture. 3. PROJECT GOAL The goal of this project is to identify a coffee and related food services operator for the Library. 4. THE COFFEE SHOP An exciting opportunity exists on the ground floor to operate a commercial Coffee Shop. The Coffee Shop is located in a high traffic area, between the two main entrances, elevators and new book display. The licence awarded to the successful Proponent would also include a seating area where customers can sit. The consumption of food within the Library itself is allowed. There are several meeting rooms and a large room which can host community events, along with teen areas, study areas, children’s areas and much more. It is also expected that the Library will be utilised by SFU students on a constant basis. 5. EXPECTATIONS OF THE SUCCESSFUL PROPONENT. The City would require the successful Proponent to offer a variety of food and beverage choices that include healthy and nutritious options for all customers, many of whom are school-aged children. The Surrey Public Library Board has approved the policy (policy 3. 8 Healthy Food Options) that the Library provides a healthy food option for programs, special events and contests. No alcohol is to be allowed. There is to be no food smell generation if preparation is required and there is to be no electric grinding (e. g. coffee beans) on the Coffee Shop floor due to noise levels. All grinding can be done in the storage room, manually or prior to Library opening hours. Loading of stock for the Coffee Shop can be done via the west entrance of the ground floor or via the elevators from the underground parkade. Persons meeting in the conference rooms are permitted to cater from external companies although there is the opportunity for the successful Proponent to cater these functions if prior arrangements are made between the two parties. The opening date for the Coffee Shop is yet to be determined, however, it is expected to be up and running by early Summer of 2011. The Coffee Shop is expected to be operational during Library opening hours. Opening times for the Coffee Shop are to be from the Library’s opening time to half an hour prior to the Library’s closing. The successful Proponent would be able to enter the building half an hour prior to the Library’s opening time. The successful Proponent is to supply any equipment needed for the Coffee Shop to function including, but not limited to, coffee machines, refrigerator, signage, counter cooler case, etc. All business licences and food permits are the responsibility of the Proponent. 8. SUCCESSFUL PROPONENT’S WORK RESPONSIBILITIES a) Should there be any structural changes which have been reviewed and approved by the City prior to the execution of such changes, the tenant is to supply all tenant improvement plans signed and sealed by professional engineers or architects to be approved by the City. b) The tenant is to provide evidence of insurance for the City`s approval as specified in the License Agreement (refer to Schedule B – License Agreement). c) The tenant is expected to supply all equipment needed to sufficiently run the coffee shop including, but not limited to, coffee machines and espresso equipment, undercounter refrigerators, shelving in the storage room, display cooler case, paper towel dispenser, milk cooler, microwave, cash register and trash bins. 9. COLD DRINK BEVERAGES The City has an agreement with The Pepsi Bottling Group (Canada), Co. (â€Å"Pepsi†), for the exclusive supply of cold drink beverages for all City facilities, including the Library. Therefore, the successful Proponent is to work directly with Pepsi for the supply of cold drink beverages, including: †¢ Carbonated soft drinks †¢ Teas other than fresh brewed †¢ Juices. †¢ Juice-based products †¢ Lemonade †¢ Isotonics †¢ Sports drinks †¢ Energy drinks †¢ Bottled water Excluded Beverages: †¢ Milk †¢ Flavoured milk †¢ Cold coffee †¢ Branded or unbranded fresh brewed coffee or tea †¢ Hot chocolate †¢ Unbranded fresh squeezed juices †¢ Smoothies and milkshakes The agreement with Pepsi is to expire in 2011. 10. SNACK FOODS The City has an agreement with Ryan Company Ltd. (â€Å"Ryan Vending†), for the exclusive supply of a healthier snack foods program and vending services for all City facilities, including the Library. Therefore, the successful Proponent is to work directly with Ryan Vending for the supply of snack foods. 11. CITY’ RESPONSIBILITIES The City is to complete the Licence Area, as set out in Schedule B, in a good and workmanlike manner, at the City’s cost, using new materials and to the following extent: a) Interior wall taped and sanded drywall to code, painted white; b) Ceiling is to be painted concrete; c) The floor will be finished with a rubber covering; d) Counter tops on the horizontal front counter is to be a white laminate; e) The vertical section of the counters shall be an East Coast maple; f) The counter at the back of the shop floor containing the sink, and the backsplash, is to be white Corian; g) There will be an apple ply edging where the vertical edge of the counters meets the horizontal at the front counter; h) There is to be recessed lighting fixtures above the back counter, surface mounted fixture on painted concrete ceiling to light signage and menu and pendant fixtures at the front counter; i) All signage, including Menu board, must be approved by the City and the design team (Bing Thom Architects). The preferred signage for the Coffee Shop is electric flat screens, however, the design team is open to ideas regarding electronic signage from Proponents. This will have no impact on the evaluation of the Proponent’ Proposal; j) The City will provide the main sink and handwash sink located in the back counter; k) A 25mm domestic hot and cold water line with backflow preventor will be installed for refrigerator and coffee machine; and l) A 20mm domestic hot and cold water pipe and a 40mm sanitary drain will be installed for each of the two (2) sinks. term The Proponent will provide the Services set out in this Schedule A and A-1 for a term not to exceed five years (including renewal) commencing in the early Summer of 2011 (the Term). BETWEEN: CITY OF SURREY 14245 – 56 Avenue Surrey, B. C. V3X 3A2 (the Licensor) OF THE FIRST PART AND:   (the Licensee). OF THE SECOND PART WHEREAS: A. The Licensor is the owner of those lands and premises located at 10350 University Blvd within the City of Surrey, Province of British Columbia, and more particularly known and described as: Parcel Identifier: 028-179-951 Parcel 1 Section 27 Block 5 N Range 2 West New Westminster District Plan BCP44240 (the Lands) on which is located theCity Centre Library. B. The Licensee wishes to obtain from the Licensor a licence to use those portions of the building located on the Lands as follows: 1. Area A Concession and Storage Room (Licence Area A) which area is approximately 141. 9 sq. ft. and shown on the plan attached hereto as Schedule A; and 2. Area B Seating Area (Licence Area B) as shown on the plan attached hereto as Schedule A (collectively the Licence Area) C. The Licensee intends to use the Licence Area for the retail sale of coffee, tea, and other products as outlined in this Licence. D. Licence Area A shall be for the exclusive use of the Licensee, and Licence Area B shall be for the non-exclusive use of the Licensee. NOW THEREFORE in consideration of the sum of ONE DOLLAR paid by each of the parties to each other and other good and valuable consideration (the receipt and sufficiency of which each party hereby acknowledges) the parties hereby covenant and agree as follows: 1. In this License the parties agree that: (a)Additional Rental means the moneys payable hereunder, together with all other sums of money, whether or not designated as Additional Rental, to be paid by the Licensee whether to the Licensor or otherwise under this License save and except Minimum Rental and Percentage Rental; (b)Commencement Date of Term means ______________, 2011; (c)Gross Revenue means the entire amount of the sales price, whether wholesale or retail, for cash, credit, or otherwise of all sales of merchandise and services, and all other receipts and receivables whatsoever of all business conducted at, in, upon, or from the Licence Area, including, without limiting the generality of the foregoing, receipts and receivables in respect of any sale effected by the Licensee using any computer, electronic, telephone, internet, or like system, where the Product is sent via the Licence. Area or by the Licensee directly to a consumer, orders taken at or received at the Licence Area, although such orders may be filled elsewhere by the Licensee, deposits not refunded to customers, the selling price of gift certificates, charges to customers in the nature of interest or carrying or financing charges, sums, and credits received, and settlement of claims for loss of or damage to goods. No deductions shall be allowed for uncollected or uncollectible credit accounts. There shall not be included in Gross Revenue: (i)any sums shown separately from the price and collected and paid out for any direct retail sales tax imposed by any duly constituted governmental authority; (ii)the exchange of goods and merchandise between the stores of the Licensee, if any, where such exchange of goods or merchandise is made solely for the convenient operation of the business of the Licensee and not for the purpose of consummating a sale which has previously been made or agreed to be made at, in, from, or upon the Licence Area or for the purpose of depriving the Licensor of the benefit of a sale which otherwise would be made at, in, from, or upon the Licence Area; (iii)the Licensee’s original cost of returns to suppliers or to manufacturers; (iv)the amount of merchandise sold when such merchandise is thereafter returned by the purchaser and accepted by the Licensee, and a complete credit is given to the purchaser; and (v)the selling price of gift or merchandise certificates or coupons sold other than from the Licence Area, provided that such gift or merchandise certificates or coupons shall be included in the calculation of Gross Revenue at the time of their redemption. (vi)Each sale upon an installment or credit basis shall be treated as a sale for the full price in the month in which that sale is made regardless of the time when the Licensee receives payment, whether full or partial, from its customer; (d)Lands means as hereinbefore defined in recital A; (e)Licence Year means a 12-month period commencing with the first day of January in one calendar year and ending on the last day of December of that year, providing that the first Licence Year shall commence on the Commencement Date of Term and end on the last day of December next following and the last Licence Year shall end on the last day of the Term and commence on the first day of January preceding that date; (f)Licence Area means Licence Area A and Licence Area B; (g)Licence Area A means those portions of the building located on the Lands shown highlighted in pink and marked as Area A. Concession and Area A Storage room, which area is approximately 141. 9 sq. ft. ; (h)Licence Area B means those portions of the building located on the Lands shown highlighted in yellow and marked as Area B. Seating Area; (i)Minimum Rental means the minimum annual rental reserved hereunder payable by the Licensee; (j)Product means coffee, tea, soft drinks, juices, pastries, sandwiches and related items as specified in the menu attached as Schedule C which menu may be amended from time to time with the agreement of the Licensor and the Licensee; (k)Percentage Rental means the percentage rental reserved hereunder and payable by the Licensee; (l)Real Property Taxes means all taxes, rates and assessments, whether general or specially levied or assessed for municipal, school, general or any other purposes by any lawful government authority payable by the Landlord in respect of the Demised Premises and shall include any other taxes payable by the Landlord which in the future are levied in lieu of or in addition to such taxes, rates and assessments the whole as finally determined for each calendar year as a result of assessment, appeal or judicial review, and shall include any legal fees, or appraisers fees incurred by the Landlord in respect of such final determination. (m)Rental means Additional Rental, Percentage Rental, if any, and Minimum Rental; and (n)Term means _______ (__) years commencing on the Commencement Date of the Term and ending on the _____ day of ________, 20__. 2. The Licensor hereby grants to the Licensee a licence to occupy and use Licence Area A on an exclusive basis and Licence Area B on a non-exclusive basis commencing on the Commencement Date of Term for Term unless sooner terminated as hereinafter provided. 3. To use Licence Area for the retail sale of the Products and to use Licence Area B to provide a seating area for the benefit of visitors to and staff of the City Centre Library and for no other purpose during the Term. 4. The Licensor covenants and agrees to pay to the Licensor, in lawful money of Canada, on the days and at the times hereinafter specified, Rental which shall include the aggregate of the sums required to be paid: (a)Minimum Rental and Percentage Rental: The Tenant shall pay the greater of: (i)Minimum Rental of $________ per month commencing on the Commencement Date of Term and the 1st day of each and every month thereafter throughout the Term; or (ii)the Percentage Rental which shall be ___% of Gross Revenue per Licence Year; (b). Additional Rental Any sums, costs, expenses or other amounts from time to time due and payable by the Tenant to the Landlord or to any third persons under the provisions of this Licence, including, without limitation, all amounts payable under Section 4. 3 and Article 5 and all amounts payable by the Tenant by way of indemnity, whether expressed in this Licence to be Basic Rent or Additional Rent or not shall be treated and deemed to be Rent and the Lan.
